Indefinite Detentions and the End of Habeas Corpus
Power Uber Alles

Perfidy loves company. George W. Bush instructed his British puppet,
Prime Minister Tony Blair, to get moving on the detention issue so
that he, Bush, would have company when he attacked the Constitution's
guarantee of habeas corpus.

Habeas corpus prevents authorities from detaining a person
indefinitely without charges; the guarantee of habeas corpus ensures
that no one can imprison you without a trial.

The Bush administration wants the power to detain indefinitely anyone
it declares to be an enemy combatant or a terrorist without presenting
the detainee in court with charges. In England the power to arrest
people and to hold them indefinitely without charges was taken away
from kings centuries ago. Bush apparently thinks he is the
reincarnation of an absolute monarch.

The puppet Blair set to work. He soon discovered that at most he could
try to pass a law that permitted the British government to hold a
detainee for 90 days, a far cry from Bush's desire for indefinite
detention. Blair took what he called his "anti-terror" legislation to
Parliament and was handed his first-ever defeat as Prime Minister.

The British Parliament knew enough history to realize that Blair's
"anti-terror" legislation was in fact the opposite. Parliamentarians
perceived Blair's proposal as a police state trick that could be used
by an unscrupulous government to terrorize Her Majesty's subjects by
the use of imprisonment without charges. The British Parliament
refused to put up with such injustice. Eleven of Blair's former
cabinet ministers joined in voting down the legislation.

That happened on Wednesday November 9.

On Thursday November 10, the Republican controlled US Senate voted 49
to 42 to overturn the US Supreme Court's 2004 ruling that permits
Guantanamo detainees to challenge their detentions. How dare the US
Supreme Court defend the US Constitution and the civil liberties of
Americans when we have terrorists to fight, argued the Republican
senators. What are civil liberties, the Republicans asked
rhetorically, but legal tricks that allow criminals and terrorists to
escape.

The Labour Party dominated British Parliament will not allow 90 days
detention without charges, but the Republican controlled US Congress
favors indefinite detention without charges of whomever Bush wants to
detain.

Nothing more effectively undercuts the image that Bush paints of
America as the land of freedom, liberty and democracy than the
Republican Party's destruction of habeas corpus.

Habeas corpus is essential to political opposition and the rise and
maintenance of democracy. Without habeas corpus, a government can
simply detain its opponents. Nothing is more conducive to one party
rule than the suspension of habeas corpus.

It is heartbreaking to watch the Republican Party overthrow the very
foundation of democracy in the name of democracy. The name of Lindsey
O. Graham, Republican senator from South Carolina, the sponsor of this
evil legislation, will go down in infamy in the book of tyrants.

The next time Bush declares that "they (Muslims) hate us for our
freedom and democracy," someone should ask him how there can be
freedom and democracy without habeas corpus.

The Bush administration has also resurrected that second great feature
of tyranny--torture. We have the right to torture say President Bush,
Vice President Cheney, and Attorney General Gonzales.

What a hypocritical spectacle the Bush administration and the
Republican Party have made of America. They boast of "freedom and
democracy" while they destroy habeas corpus and practice torture.

Americans must recognize the Bush administration and the Republican
Party for what they are. They are tyrants. They are bringing evil to
the world and tyranny to America.

According to the Washington Post (Nov. 11), there are 750 detainees at
Guantanamo. These people have been held for 3 or 4 years. If the Bush
administration had any evidence against them, it would be a simple
matter to file charges.

But the Bush administration does not have any evidence against them.
Most of the detainees are innocent travelers and Arab businessmen who
who captured by warlords and armed gangs and sold to the Americans who
offered payments for "terrorists."

The reason so many of them have been tortured is that the Bush
administration has no evidence against them and is relying on pain and
the hopelessness of indefinite detention to induce self-incrimination.
The Bush administration is desperate to produce some "terrorists."

What has become of the American people that they permit the despicable
practices of tyrants to be practiced in their name? The Bush
administration is in violation of the US Constitution, the rule of
law, the Geneva Convention, the Nuremberg Standard, and basic
humanity. It is a gang of criminals. The Republican Party is so
terrified of losing power that it supports a tyrannical administration
that has brought shame not just to the Republican name but to all
Americans.

When a Republican next campaigns, all he can say is "vote for me
because I want power to lock you up and torture you."

happens to be critical, and it affects all current versions of Windows

(2000, XP and 2003). The parsing of malicious Windows Metafiles (.WMF

and .EMF) can trigger various vulnerabilities, including the execution

of arbitrary code. This issue contains pointers to some of the

technical advisories relating to the bugs fixed in the patch.

Multiple RealPlayer bugs were also reported last week. Although some

bug details were withheld, there's enough information to know there

are remotely exploitable buffer overflows that lead to the execution

of arbitrary code. Since these vulnerabilities can be triggered by a

Web site serving a malicious .RM file, all Windows users with previous

RealPlayer installs should update sooner rather than later. Further

I was on the IMDb site, and I saw this:

"Hotel heiress Paris Hilton escaped unscathed from a freak car crash
in the early hours of on Wednesday morning. The reality TV star was
leaving a Hollywood nightclub in a plush silver Bentley, when her
vehicle collided with a heavy goods wagon. The incident was caught on
camera by eager photographers; one image shows Hilton blowing a kiss
towards helpful police officers as she fled the scene. It is not known
how fast the star's car was traveling. Los Angeles cop Michael Lopez
says, "They decided to leave the scene because the paparazzi was
there." Lopez also confirmed no one was hurt in the smash."

I am so glad to grateful that there is a place we can get the REAL
news. I'm going to stop wasting my time going to websites that have
this kind of JUNK on them:

"Republicans Call For Joint Investigation into Possible Prison Leak

A week after the Washington Post reported the existence of a secret,
CIA-run prison in Eastern Europe, Republican Senate Majority Leader
Bill Frist and House Speaker Dennis Hastert have called on the Senate
and House intelligence committees to convene a "a joint investigation"
into who leaked the information. The CIA has notified the Justice
Department classified information was leaked in the disclosure of the
prisons. This could set the stage for a possible criminal inquiry
similar to the one launched following the outing of CIA operative
Valerie Plame."

These prisons are in Romania and in Poland. This information from
Robert Fisk, the outstanding British Journalist who is not owned by
the administration and their cronies the way US journalists are (such
as the award winning professional liar Judith Miller). It's
interesting that both of these countries had phony "revolutions", in
which eastern bloc tyrants were replaced by tyrants responsive to the
White House. That Lech Walesa is a virtual CIA asset, isn't he? What
other kind of "labor activist" would be hailed as a hero by Reagan?
No other kind, that's who.

So now they are running torture prisons there, and they are trying to
make it a crime for the American people to even know it.

This is very distressing, but I'm so glad to learn that nobody was
hurt in the crash.

Don't imagine for a moment that a poor person will prevail against a
rich person in a copyright infringement suit, no matter what the
merits of their case. It's clear from the headline which side the
IMDb is on:

Spears "Fraud" Dismissed in Court

A lawsuit claiming pop star Britney Spears plagiarized her hit record
"Sometimes" have been dismissed by a judge in Indianapolis, Indiana.
Songwriter Steve Wallace alleged the 23-year-old stole and copyrighted
his track, originally penned in 1990, and released her version on her
1999 debut album Baby One More Time, and on 2004's Greatest Hits: My
Prerogative. Wallace maintained that a few weeks after finishing his
song, he executed what is known as a 'poor man's' copyright - sealing
his work in an envelope and obtaining a postmark - making Spears'
later copyright void. But his suit was thrown out by US District Judge
John D. Tinder last week, despite a side-by-side comparison of the
songs in court showing a striking resemblance. Spears' lawyer David R.
Baum quashed rumors the two parties had reached a financial
settlement. He said, "I cannot emphasize enough this was not a
settlement but a dismissal."

Conversely, don't expect any poor person to affoid ruin if a rich
person decides to take them to court.

[CanYoAssDigIt] Give your mother a hug today...

The RTE has lifted their prohibition on English language songs, so the
hipster music they play on An Taobh Tuathail is unfortunately a lot
more like the hipster music I can hear elsewhere.

They just got through playing Martha Wainwright's song about her
father, Loudon. The announcer was rattling on about it in Irish, but
when it came time to give the name of the song (which is in English of
course) he couldn't bring himself to say it.

He announced as "Bloody motherhugging gas hole."

BTW, I can't quite put her in the same category as the despicable
Eminem, because Loudon has a bully pulpit, too, he could put a song
out called "My daughters a selfish bitch, she conspired with her
therapist to create the LIE that I ruined her whole life," but it's
still awkward. You can ignore the shit, and have people believe it, or
try to respond and start WWIII in your family.

Maybe he is an asshole, he did name his kids Rufus and Martha, how
cruel and unusual is that? But he comes from a line where they named
3 generations "Loudon" so he can be forgiven for not knowing any
better, it seems to run in the family.

On a non-political note, I was looking through the bottom 100 movies
of all time, according to the users fo the imdb:

I was very pleased to see that these people recognized the awfulness
of Crossroads. what a turkey that movie is, but I've never heard
anybody else saying it.

but then I looked closer, and saw that they were talking about a 2002
movie with Britney Spears, and not the 1986 movie with Ralph "help me,
I've fallen and I can't act!" Macchio.

Collectively, the users of the imdb gave that stinkfest 6.5 out of 10
stars, which is depressingly high.

But the collective imbd users are somewhat redeemed by NOT placing the
excellent movie Ishtar in the bottom 100, as certain frequent users of
the imbd websight might....

"Blaming Others for Their Own Failures"
What Country was Bush Talking About?

You have to wonder whether President Bush

[Hey, isn't he the guy we want to impeach?!?]

just thinks we Americans are stupid, or whether he is so out of touch
with reality that he isn't aware of what he's saying.

In Latin America, trying to sell his American imperialist snake-oil to
a group of nations whose leaders, and especially whose people, were
skeptical to hostile, Bush argued for the American model, instead of
the neo-socialist approach being taken and advocated by the wildly
popular Hugo Chavez in Venezuela.

That latter approach, the president said, "seeks to roll back the
democratic progress of the past two decades by playing to fear,
pitting neighbor against neighbor, and blaming others for their own
failures to provide for their people."

Now at the moment, it would be hard to find any failures in Venezuela,
where Chavez has been using his country's windfall revenues from oil
to fund schools, to help displaced and unemployed workers take over
shuttered factories and run them as co-ops, and to bring in doctors
from Cuba to bring health care to the country's poor.

Chavez, incidentally, has survived a most likely U.S. -orchestrated
coup, and has been elected twice by wide margins, in elections that
were monitored by international observers (including former U.S.
President Jimmy Carter) and declared to have been fair.

As for the U.S., it would seem to me much closer to what Bush was describing.

Certainly the Bush administration's introduction of arrest and
indefinite detention without charge or recourse to an attorney or the
courts, his authorization of torture, his ramming through Congress of
laws granting new police powers, and his two presidential campaigns'
successful efforts to subvert the election process, notably in Florida
and Ohio, have "rolled back the democratic progress" in the U.S. His
declaration of a so-called war on terror and his Homeland Security
Department's blatantly political use of terror alerts to divert public
attention from his failures and various political crises have played
to fear. His effort to introduce a neighborhood spy program (Operation
TIPS), and his administration's support for ethnically, racially and
religiously-based arrests and round-ups of alleged "terror" suspects
has "pitted neighbor against neighbor." Finally, if his response to
the Katrina disaster in New Orleans wasn't a case of "blaming others"
for his own failure to provide for his people, I don't know what was,

His comment was no doubt met with laughter and derision in Argentina,
Brazil and other Latin American countries.

Sadly, it was simply reported without comment in this nation's excuse
for a news media.

Brown Complained, Discussed Wardrobe as Katrina Hit
And newly-released e-mails continue to call into question the job
performance of former FEMA head Michael Brown. On the morning
Hurricane Katrina hit the Gulf Coast, Brown wrote to a colleague: "Can
I quit now? Can I come home?" A few days later, he wrote to an
acquaintance: "I'm trapped now, please rescue me." In other e-mails
written during the days leading up to and during the storm, Brown
discussed searching for a dog-sitter and mused on his wardrobe. Three
days before Katrina made landfall in Louisiana, Brown wrote to his
press secretary Sharon Worthy: "Tie or not for tonight? Button-down
blue shirt?" Days later, Worthy advised Brown: "Please roll up the
sleeves of your shirt, all shirts. Even the president rolled his
sleeves to just below the elbow. In this [crisis] and on TV you just
need to look more hard-working." On August 29, the day the storm hit
New Orleans, Brown received an e-mail from deputy director of FEMA
public affairs Cindy Taylor. Taylor wrote: "You look fabulous – And
I'm not talking about the makeup!" Brown replied: "I got it at
Nordstroms... Are you proud of me?" Brown wrote in another e-mail one
hour later: "If you'll look at my lovely FEMA attire, you'll really
vomit. I am a fashion god." Two days later, Brown received an e-mail
from Marty Bahamonde, one of the only FEMA employees on the ground in
New Orleans. Bahamonde told Brown "the situation is past critical" at
the Louisiana Superdome. Brown responded: "Thanks for the update.
Anything specific I need to do or tweak?" Brown resigned as FEMA
director September 12th. He continues to collect a $148,000 dollar
annual salary

No, WE really don't want to do that. WE are in favor of democracy,
and supporting governments that serve their people, not pirates and
thugs that steal elections, illegally invade other countries, and loot
countries (both home and abroad).

Pirates and thugs who do the above sort of thing approve of
assassinating elected foreign heads of state that act in the interests
of their own people, rather than in the interest of multinationals.
Twisted freaks who think that they can command God to destroy states
with hurricanes want to assassinate Hugo Chavez.

Dumbshits stupid enough to take Caligula and Robertson seriously may
cheer on attempts to destroy democracy and economic development in
other countries through military intervention and political
assassinations.

As people who believe in democracy, the rule of law, fair play, etc
etc, WE most assuredly don't want to assassinate Hugo Chavez.

BTW, any political leader interested in serving (rather than ruling)
their people have no choice but to resist "free trade" with the united
states. Clinton and the Bushes shove these "agreements" down people's
throats like the school bully offering to freely trade your a dead
slug for your lunch.. I just heard a story on the news where a NAFTA
arbitration panel ruled for the third time against US tariffs imposed
on Canadian softwoods coming across the border. How is Caligula's
regime responding? Ignoring the ruling, of course, because they are
supposed to get a dead slug, and Caligula and the interests that
support him are supposed to get a free lunch (like the one he's been
getting his entire life). Free trade is not the intent with these
agreements at all. A few people in this country understand this.
Almost everybody everywhere else understands it.

This kind of jamming a thumb into the eye of even your closest trading
partners is stupid and short-sighted. Anybody, foreign or domestic,
that is able to resist policies of assassination and economic bullying
should do so.

One of my wife's over-educated friends sent the attached list,
prefaced by this message: "And this is as nice as I could imagine
being about the fucking fool."

He's probably another one of those deluded fools who thinks he could
have handled the Katrina situation better than Dubya. Just because
he's an MD.

But seriously, just before the chuckles - are these for real? The
Leno and Letterman jokes are similar, and are neck-and-neck in the
"most contemptuous" race. One of them is supposed to be Bush
detracter and the other a Bush supporter? I can't tell them apart.

Have I ever said anything more critical about the old disassembler
than these guys? I wonder how much hate mail they get, saying they
aren't really citizens, they should leave the country, etc.

We are proud of our heritage and those who have so honorably defended our freedoms. We celebrate Independence Day, Memorial Day, Veterans Day, and Flag Day. We have parades, picnics, and barbecues where we proudly wave our flag.

As an American, I have the right to wave my flag, sing my national anthem, quote my national motto, and cite my pledge whenever and wherever I choose.

If the Stars and Stripes offend you, or you don't like Uncle Sam, then you should seriously consider a move to another part of this planet. The American culture is our way of life, our heritage, and we are proud of it.

We are happy with our culture and have no desire to change, and we really don't care how you did things where you came from. Like it or not, this is our country,
our land, and our lifestyle.

Our First Amendment gives every citizen the right to express his opinion about our government, culture, or society, and we will allow you every opportunity to do so. But once you are done complaining, whining, and griping about our flag, our pledge, our national motto, or our way of life, I highly encourage you take advantage of one other great American freedom:

THE RIGHT TO LEAVE!

Another thing: To those who do complain about the usage of words like 'God'
and 'American' and speaking the language of our great nation, TRY GOING TO
ANOTHER COUNTRY AND SPEAK AGAINST WHAT YOU DON'T LIKE. YOU WILL MORE THAN LIKELY END UP JAILED OR EVEN KILLED.

In America, you take your right to complain for granted. The more patriotism that is removed from where our children are taught, the less our children will learn about what it is to be an American and our nation's spirit will slowly be killed.

[CanYoAssDigIt] Caligula: The Master of Disaster

On some other list I'm on (one full of mostly stupid people, unlike
this bastion of higher reasoning), the topic of the New Orleans
disaster came up. There was the usual sparring, and then somebody
said "nobody can say they could have done any better."

I immediately posted that I in fact KNEW that I could of and would
have done better. Jeez, you would have thought I was claiming to be
Buckaroo Banzai or something. The flaming was just crazy, and the
usual invitations to leave the country, declarations that I was a
non-citizen, etc.

I tell ya what, anybody who doesn't think that they could do better
that that crowd of profoundly stupid and corrupt pirates and thugs
currently in power either has some profound self-esteem issues,
perhaps even mental illness.

And the evidence just keeps rolling in...

FEMA Scandal Widens as Internal E-mails Are Made Public
More details have emerged depicting the extent of the neglect and
irresponsibility of former FEMA Director Michael Brown in his roll in
the scandal of the government's handling of Hurricane Katrina. On
Thursday, FEMA official Marty Bahamonde testified in front of the
Senate Homeland Security Committee. He was the first official from the
agency to arrive in New Orleans ahead of Katrina. In the midst of the
chaos and horror of the hurricane's aftermath, Bahamonde sent a dire
e-mail to Michael Brown saying victims had no food and were dying. No
response came from Brown. Instead, less than three hours later, an
aide to Brown sent an e-mail saying her boss wanted to go on a
television program that night. But first, the aide said, Brown needed
at least an hour to eat dinner at a Baton Rouge restaurant, writing,
"He needs much more than 20 or 30 minutes." Some 19 pages of internal
FEMA e-mails revealed Thursday show Bahamonde gave regular updates to
people in contact with Brown as early as August 28, the day before
Katrina hit. They appear to contradict Brown, who has said he was not
fully aware of the conditions until days after the storm hit.
Bahamonde arrived on Aug. 27 and was the only FEMA official at the
scene until August 30. Subsequent e-mails told of an increasingly
desperate situation at the New Orleans Superdome, where tens of
thousands of evacuees were piled in. Bahamonde spent two nights there
with the evacuees. On August 31, he e-mailed Brown saying, "estimates
are many will die within hours." He described the situation as "past
critical." It was just moments after that email that Michael Brown's
press secretary, Sharon Worthy, wrote colleagues to complain that the
FEMA director needed more time to eat dinner. Worthy wrote,
"Restaurants are getting busy...We now have traffic to encounter to go
to and from a location of his choise (sic), followed by wait service
from the restaurant staff, eating, etc. Thank you."

That Bono's keeping some strange company these days. He was very tight with Jesse Helms, who's image benefited from the association (remember that picture of Elvis and Nixon?) but what did the poor Bono says he speaks for get out of it? A big fat goose egg, not even one you can eat.

It's telling that Bush wants to meet with him. You can tell the really effective people, because Bush refuses to talk to them. Cindy Sheehan, for example.

But I can't say it half as well as my old buddy Dave Marsh:

"Nothing is more important than passion," Jon Bon Jovi said on June 17 at Oxford University. "Whatever you decide to do in life, just be passionate about it." Did no one think to whisper the words "Timothy McVeigh" in his ear?

Still, that wasn't the dumbest thing a rock star did on a college campus this month. U2's Bono lapped the field during his June 7 appearance at Harvard, where he cozied up to economist Jeffrey Sachs, beaming in the front row. Bono's passion is Third World debt relief. Sachs is an expert on it. As CounterPunch reported, "the Harvard prof...helped devise the 'shock therapy' scheme that pillaged the Russian economy, left millions in poverty, and made billionaires out of a few insiders who were primed to capitalize on the privatization of federal assets.... His approach toward debt issues is the same old Faustian bargain - debt will be forgiven if those nations agree to privatize their natural resources: water, natural gas, timber, minerals."

Bono's passion knows no limits. Sachs is not quite the bottom of the barrel. Bono has even cozied up to the veteran race-baiter Jesse Helms, who actually doddered into a U2 show a few days before the Harvard debacle.

Helms has an interesting history in mingling music and politics. In 1993, he and the vastly overrated "songwriter" Senator Orrin Hatch were in an elevator with Carol Mosely-Braun, the only black woman ever to serve in the U. S. Senate. "Watch me make her cry. I'm going to make her cry," Helms said. "I'm going to sing 'Dixie' until she cries." He sang the racist lyrics about the good old days of slavery until the elevator stopped.

Mosely-Braun had the good sense to walk away from Helms and his cronies. Sadly, at its D.C. show, U2 gave shout-outs to Helms, several other Senators and Scott Hatch, former executive director of the national Republican Congressional Campaign Committee. Senators from both parties gladly cooperated with Hatch in setting up meetings with Bono. Hatch let it be known he worked for free, as if bringing a major media star around wasn't its own reward. ("You've never seen star-fucking 'til you've been to Capitol Hill," as a friend of mine who worked for the RIAA put it when he left.)

One thing Bono will NOT get out of this is American cooperation with debt forgiveness. This Senate certainly isn't going to get rid of the law it just passed that forbids indebted Americans from getting credit card debt relief by declaring bankruptcy. The Democrats who now control the Senate have neither issue on their agenda. Do we need to guess where Helms, the most aggressive reactionary in the Senate, stands on these matters?

If you believe that meeting with the powerful is the only route to justice - as Bono has shown he does in his dealings with the UK and Irish governments on Ulster peace - this is where your passion puts you. But huddling and cuddling with the people who create the problem isn't the only way to fight for what's right. Jackson Browne and Steve Earle also haven't ended poverty by aligning themselves with the Kensington Welfare Rights Union. But at least they get their picture of what debt relief means from the poor themselves. And they don't have to put up with a batch of phony political cronies and economic snake oil hustlers crowding the hallways backstage. That's a start.

I hope Bono has a steel-plated back. If he stays in this company, he'll inevitably need it.

Bush Approval at All-time Low—2% Among African-Americans
Meanwhile, the latest poll on President Bush shows what some analysts
are saying may turn out to be one of the biggest free-falls in the
history of presidential polling. According to a new NBC/Wall Street
Journal poll, Bush's job-approval rating among African Americans has
dropped to 2 percent. That drop is thought to be key in Bush's overall
approval ratings falling to an all-time low of 39 percent. A few
months after 9/11, the NBC/Wall Street Journal poll found Bush's
approval rating among Blacks at 51 percent. As recently as six months
ago, it was at 19 percent. The latest numbers are attributed in part
to the government's handling of Hurricane Katrina and its aftermath.
The poll also found that just 29 percent of people think Supreme Court
nominee Harriet Miers is qualified to serve on the nation's highest
court.

If this is true, that nutty Kayne West is so far out there on the
margins with his crazy conspiracy theories about Bush not caring about
what happens to African Americans... it's only him and 98% of blacks
in the country!

Actually, I think they meant to say "2 African Americans approve of
Bush's performance." That would be Condi Rice and Clarence Thomas.
Michael and Colin Powell used to, but they stopped feeding at that
particular trough, so they don't have to any more.
