[ItsAllAboutMeMan] Re: [progressive] BBC 3/19/09: Cuba neighbours to restore ties

"The announcements come a week after the US Congress voted to lift restrictions on relations with Cuba imposed by the Bush administration.

Under the new rules, Cuban-Americans will be allowed to travel to the island once a year and send more money to relatives there."










The BBC is almost deceptive in this wording. In point of fact, the Obama Administration only restored rights to certain people that all Americans used to enjoy (see the article below).  They are practicing discrimination - it would be interesting to launch a civil rights lawsuit against them on this basis.

All Canadians have the right to travel to Cuba.  I don't suppose the Obama Administration could stop me from going to Cuba if I leave from here - but would they take me into custody next time I use my passport to get back into the US, when they saw the Cuba stamp in it?

When last in Europe, I traveled freely from country to country without showing my passport.  I never took it out after we left the airport... until we returned to the airport.  

I wonder when the Obama Administration will get over this terrible fear of the deadly Cubans and Canadians?

Travel Ban Eased--But Only for Cuban-Americans

Why Obama's New Cuba Rules Violate the Constitution

By NELSON P. VALDÉS

Section 621 of the Omnibus Appropriations Act of 2009 authorizes Cuban ancestry persons subject to the jurisdiction of the United States to travel to Cuba to visit close relatives for an unlimited period of time once every 12 months and to engage in travel-related transactions at the "maximum per diem rate" in effect at the time of travel. The Cuban Americans will be permitted, as well, to send money to their relatives. This "initiative" has been described as a change in policy toward Cuba.

The guidelines to be implemented by the Office of Foreign Assets Control of the US Treasury Department do not allow non-Cuban ancestry Americans to travel to the island, something that was permissible before June 6, 2004.

The new ruling has serious and profound legal consequences. The new rules violate the equal protection under the law that is supposedly secured for all Americans. In other words, advantageous and preferential treatment is provided to a set of people of a particular national origin [Cubans]. This unusual type of discriminatory advantage [my terminology] based solely on national origin and national ancestry is one in which the majority of the American population is discriminated while a minority is benefited. In other words, a different standard on the right to travel to Cuba is used for Cuban ancestry persons and the rest of the population. One enjoys the right to travel; the majority is denied the same right.

Usually, discrimination refers to a situation in which a particular minority group of people is denied rights. In that sense discrimination is negative. Yet, in this particular case, discrimination grants people rights that others are not permitted to enjoy. Hence, affirmative discrimination should not be confused with affirmative action - a policy by which a minority is given the resources to enjoy the same rights as the majority of the population.

Title VII of the Civil Rights Act of 1964 prohibits discrimination on the basis of national origin. The ethnic traits of Cubans give them a comparative advantage that is not accorded to ANY other ethnic group in the United States. Such a comparative advantage, of course, implies a negation of equal protection.

It should be noted that if a US citizens marries a Cuban, then he/she can travel to the island as well. Thus, the concept of national origin does not refer to merely coming from Cuba. And American could obtain the right to travel, but only through marriage to a person of Cuban ancestry. Hence, the right of an American to travel is enhanced when that person marries a person who can claim to be from Cuba, or to have an ancestor who was Cuban.

Thus, the US Congress in making an exception of the Cubans' right to travel have violated the Equal Rights Act as well as the Constitutional right to travel that applies to all US citizens.

Although I am a Cuban American and benefit from the new rules, I think it is an outrage that such a right is denied to people who do not have a familial connection with Cuba. Why such a differential policy that limits the right to travel of so many American citizens? How can any one sustain a foreign policy rooted in a two-tier classification of the people of the United States?

Under the new rules, permanent resident aliens from a Cuban ancestry in the US will enjoy a right of travel that non Cuban ancestry US citizens do not have. Hence, we are confronted with a clear and obvious violation of the 14th Amendment since non-Cuban ancestry citizens of the United States are considered members of an inferior or dependent nationality and a non participant in the enjoyment of a right granted to others. Such inequality treats the broad majority of American citizens who are not of Cuban ancestry as second class citizens when it comes to the right to travel.

The Supreme Court's equal protection jurisprudence has established that all legislation identifying national origin for differential treatment should be considered "suspect" and subject to strict scrutiny. [1] Moreover, the right to unconstrained travel is founded on principles of non-discrimination and equal citizenship. That is why, the present policy on travel to Cuba and its unequal application should be rejected. Every US citizen and resident alien should have the right and freedom to travel to Cuba, if they wish to do so.

Thanks for the nice thoughts.  It's very nice that somebody has found me who appreciates my multitude of good qualities.  Don't get me wrong, my wife is great, but I don't always get all the support from her I think I deserve.  Not that I'm thinking about getting rid of her... but I have been thinking about exercising the legal right that Anderson Island gives its citizens to practice polygamy.  Of course, you know all about that, since you're from Anderson Island too!

It's funny I've never seen you at the general store or on the ferry, but I guess that there are still a few people there I haven't met.  You must have just moved from Braddock Hills, PA, which your profile says is your home, huh?

Well, I'm talking about the crazy, homeless guy that thinks he's Gene Simmons... just like the crazy homeless guy who thinks he's Englebert.  And the guy who passed himself off as Peter Criss, remember that one?

I got another mail from a member of the brain trust.. You'd think it was obvious from context that i knew this guy was not "Humpy."

these guys must have google alerts set for the hump (like I do for the movie Ishtar) so they can go out and correct what they believe are misconceptions about the Hummer.

I too have had the pleasure of meeting Engelbert Humperdinck he is an absolute gentleman.

Engelbert has sold over 150 million records and sold out every major concert venue in every corner of the globe he certainly has NOTHING to prove.

As far as younger acts, Engelbert not only encourages youngsters but also writes and manages for a select few up and coming acts.

Perhaps the ignorant liar who originally posted this dribble got his demo knocked back????

Engelbert s a superstar and super person forever giving to various charities around the globe.

Now - as for the lumping-in with Gene Simmons - inferring Gene is washed-up - I do take umbrage with that. That is an opinion my friend - and not a particularly informed one. Gene's popularity is still quite high both with KISS (world tour selling out in every venue) but also with his own reality TV show and busy media/movie/producer schedule. Surprising? Perhaps, but true. Not a comeback either. He's maintained a viable presence since the beginning. You won't find KISS ever playing fairs and gin joints. If it doesn't have 30,000 seats or more - it ain't happening.

[ItsAllAboutMeMan] according to radio news reports, 1500 people paid hundreds to hear Bush in Calgary...

200 showed up to protest. There is probably the usual distortion.
Maybe 400 protesters showed up. Still, I think that the Canadian Left,
like the American Left, would rather be oppressed than win.

I wasn't there - I fruitlessly tried to organize a carpool to drive
from Edmonton to Calgary. I didn't get one taker, and searches online
didn't turn up any organized efforts.

A couple of years ago I moved back to my conservative hometown to take
care of my father, One early day, when I could still leave him alone
for an hour or two at a stretch, I was in town one day when I saw some
interesting activity in Memorial Park in town. I stopped by, and saw
that it was the FOR traveling boots exhibit (seems like its always
footwear).

There was some big burly guy singing 40 year old resistance songs,
looking very stern and pleased with himself. Nobody much was paying
attention. I wandered around. I recognized somebody - he was a high
school teacher when I was in high school. Somebody who could always be
counted on to fight the good fight. He was talking to one of the
other faithful. I stood waiting for my chance to talk to him. He never
even glanced in my direction. I waited 10 minutes. Finally I gave up,
and wandered over to the merch table. I bought an FOR shirt, I thought
it might get their attention if I laid a little money down. I signed
up for a volunteer list. I said I'd do anything. I left my phone
number and e-mail address. I never heard from anybody for the rest of
the time I lived there.. You can always count on the left to erect a
very small tent, and tie the flaps shut.

On the way out, I saw the big guy had been replaced by a little thin
guy playing keyboards and singing about his personal victimization.
He was so stereotypical it would have been funny if it wasn't so
depressing. The big guy was standing by accepting homage from a crony.
Or maybe they were discussing what you can substitute in for a
tortoise shell pick (or where you can get these illegal devices), for
all I know. Nobody noticed me arrive, nobody noticed me leave.

That, to me, is the state of the American Left. If you want to know
how it should be done, go to a fundamentalist church. They are
bursting at the seams with believers, but still they act like they've
been waiting all their lives for you to show up.

I'm enjoying the conversation tremendously. It seems striking that
people in a cacophonous outfit like this would so instantly and
completely stand up for the status quo, but on reflection it's
completely predictable.

In ancient and medieval times, festival days involving social
inversion through the election of lords of misrule, etc. were
endorsed by authority because it was understood that if you play act
for a day now and then that the rabble is in charge and the ruling
elite is beneath them, it will keep them from questioning their (real)
roles the rest of the year.

So go ahead and pretend to be so wild and crazy and uninhibited and
psychologically free, put on that Santa suit, or take off all your
clothes and run around in the desert... that's cool, just as long as
you willingly put on the yoke (or the wingtips or ties or had or
double chin or whatever the uniform is this year) the rest of the
time!

I'm really not if favor of revolutionary fervor personally, the French
revolution got a bit out of hand, for one example. But I'm not really
in favor of play-acting either. I appreciate people that resist in
small ways, in day-to-day life. It's a hard job, good on those that
do it, I say.
